The Faculty of Syariah & Law (FSU), Universiti Sains Islam Malaysia (USIM) with the cooperation of Dewan Bahasa & Pustaka (DBP) and Malaysian Bar will organized the “Malay Language Moot Court Competition 2017” that will be held in FSU, USIM on 11 & 12 November 2017. This competition is the second after it was first held in Universiti Kebangsaan Malaysia (UKM) last year. The main objective of the competition is to uphold the special position of Malay language in the country in line with Article 152 of the Malaysian Federal Constitution which states “Malay language as national language. However, everybody is free to learn and use other languages except on official purposes such as any purpose regards to the Government, Federal or State, and any purpose of a public authority”. Our Parliament subsequently enacted the National Language Acts 1963/67 which provided that the Malay language shall be used for all official purposes. The Acts specifically provide that all court proceedings and parliamentary and state assembly proceedings are to be conducted in Malay, but exceptions may be granted by the judge of the court, or the Speaker or President of the legislative assembly. According to Section 8 of the National Language Acts 1963/1967 “All proceedings (other than the giving of evidence by a witness) in the Federal Court, Court of Appeal, the High Court or any Subordinate Court shall be in the national language: Provided that the Court may either of its own motion or on the application of any party to any proceedings and after considering the interests of justice in those proceedings, order that the proceedings (other than the giving of evidence by a witness) shall be partly in the national language and partly in the English language”.
